Radio One, Inc. Sued for Breach of Contract

radio-one-logo-850x471Direct Media Power, Inc., the largest liquidator of unsold media in the U.S., has filed a Counter Complaint for Breach of Contract and Copyright Infringement and Tortious Interference against Radio One, Inc., one of the nation’s largest radio broadcasting companies.

Direct Media Power, through its attorneys, has filed a breach of contract counter suit, with the additional claims of tortious interference and contributory copyright infringement against Radio One, Inc., a national broadcast media company.

Direct Media Power, Inc., one of the largest broadcast radio pay-per-call advertiser in the country is seeking compensatory damages and injunctive relief, claiming Radio One breached a media contract for radio airtime, as well as willfully continuing to sell and use the copyright-protected assets, of Direct Media Power, Inc., which interfered with the economic advantage of such assets.

The lawsuit claims that Direct Media Power, Inc. contracted with Radio One to run a specified and limited number of commercials on a weekly basis for the various brands of Direct Media Power and their clients, and that during the contract period Radio One aired a significantly greater number of radio spots which greatly exceeded the contracted amount. Through the contract period Direct Media Power paid Radio One a total of $2,185,257 for the contracted air time, however Radio One claims they are owed sums far above the contracted amount. In addition, the suit also alleges that Radio One would routinely submit invoices several months after air dates which would make it next to impossible for Direct Media Power to collect from its clients, Radio One would double and triple bill for the same spots on various invoices and Radio One would routinely bill Direct Media Power for spots that were not Direct Media Power owned commercials.
